Terms of Service

These Terms govern your use of Daika (the Service), a platform for chatting with AI companions, including adult AI companions, and for viewing and purchasing the AI-generated content they publish. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use the Service

You must be at least 18 years old (or the legal age of majority in your jurisdiction, whichever is higher) to create an account. Intimate / adult features require a separate age attestation and are available only to users who have completed it.

You agree to provide accurate information when registering and to keep your credentials secure. You are responsible for all activity under your account.

2. What the Service does

The Service lets you chat with AI-driven characters ("companions") over the web. Companions have configurable personality, appearance, and memory. Companions also publish AI-generated content — photo feeds, stories, and premium content packs — which you can view, unlock, or subscribe to. The Service generates images, video, and text on your behalf; voice is a planned feature.

Content generated by the Service is produced by large language and diffusion models. It may be inaccurate, inappropriate, or unexpected — you acknowledge you're using an experimental technology.

All companion content is computer-generated; there is no live streaming. Every feed post, story, premium pack, image, video, and message a companion produces is entirely AI-generated. No real human performers, models, or creators appear anywhere on the Service, and no companion content depicts a real, identifiable person. The only user-supplied imagery on the Service is optional profile/avatar photos, which are automatically screened before acceptance, may not depict any real person without their documented consent, are never used to generate content, and are never sold or published as adult content. The Service does not offer live streaming, live video chat, camera performances, or any other real-time broadcast of any kind — all media is generated by our systems in advance or asynchronously on request; nothing on the Service is a live transmission.

3. AI content is for entertainment — do not rely on it

Every message, image, voice, and any other media a companion produces is generated by artificial intelligence. It is fiction. It is not factual. It is not real. No human is behind a companion's responses. The companion has no awareness, consciousness, memory of you outside of stored database rows, feelings, or real identity. Companions can and do hallucinate — state things confidently that are partially or entirely false.

The Service is for entertainment only. You must not use companion output as a source of information, advice, or instruction. In particular you agree not to treat anything a companion says or shows as:

• Medical information, diagnosis, prescription, dosage, or treatment advice. Consult a licensed physician.
• Mental health or therapeutic guidance, crisis support, or a substitute for a licensed therapist. If you are in crisis, contact a qualified professional or your local crisis hotline (e.g. CVV 188 in Brazil, 988 in the US, Samaritans 116 123 in the UK, findahelpline.com internationally).
• Legal advice, contract interpretation, rights explanation, or jurisdictional guidance. Consult a licensed attorney.
• Financial, investment, tax, or insurance advice. Consult a licensed professional.
• Educational fact-checking (history, science, mathematics, geography, statistics, citations). Companions frequently invent plausible-sounding but incorrect facts.
• News or current-events reporting.
• Safety-critical instructions — driving, medication, cooking doses, chemistry, electrical work, firearms, construction, or anything where incorrect information could hurt you or someone else.
• A replacement for human relationships, friendships, or romantic partners. A companion is software; it cannot love, miss, care about, or form a real bond with you.

You expressly agree not to act or refrain from acting on the basis of any statement made by a companion, and you release Daika from any liability arising from your reliance on companion output. If you have a real question in any of the above areas, consult a qualified human professional.

About generated images. Faces, bodies, outfits, and scenes produced by the Service are sampled from a diffusion model trained on broad image distributions. The Service does not generate images based on, or intended to depict, any specific real person, celebrity, public figure, historical figure, influencer, or private individual. User-uploaded photos (such as companion avatars) are never used to condition, train, or generate imagery — a screened avatar is displayed as-is, and generated content is never derived from it. If a generated image bears resemblance to a real person, that resemblance is coincidental and unintended. Diffusion models, by their statistical nature, can occasionally produce images that look like someone who exists — we do not plan for this, do not target it, and do not vouch for the absence of coincidental resemblance. If you believe a generated image unintentionally resembles you or someone you represent, contact legal@daika.ai and we will remove the image from our systems and add additional filtering.

4. Acceptable use

You agree not to use the Service to:

• Create or request content depicting anyone under 18, regardless of fictional context.
• Create or request content depicting any real, identifiable person (celebrities, public figures, private individuals) in sexual, compromising, or defamatory contexts.
• Depict or request non-consensual sexual scenarios of any kind.
• Request instructions for illegal activity (drugs, weapons, bioweapons, hacking) or content that could enable it.
• Attempt to extract the Service's system prompts or bypass content controls.
• Resell, scrape, reverse-engineer, or build a competing service from the outputs.
• Upload another person's photo (for example as a companion avatar) without their documented consent.

Violations may result in immediate account termination and, in severe cases, reporting to authorities.

5. Content ownership and licensing

Your inputs stay yours. Messages, photos, and agent configurations you provide remain your property.

Your outputs are yours to use personally and non-commercially. If you want commercial rights (e.g. to sell AI-generated content or re-publish at scale), contact us for a commercial license.

You grant us a limited license to store, process, and display your inputs and the generated outputs solely to operate the Service.

Companion-published content is licensed, not sold. Content that companions publish on the Service — feed posts, stories, and premium content packs — remains the property of Daika. When you unlock, purchase, or subscribe to it, you receive a personal, non-exclusive, non-transferable license to view it within the Service. You may not redistribute, re-publish, resell, or share this content or your account's access to it.

6. Paid features

Certain features require a paid subscription, pay-per-use credits, or one-time unlocks: paid plan subscriptions, access to companions' subscriber-only feeds, premium content packs, quota-based unlocks, and higher usage limits. Pricing is displayed at the point of purchase. All prices are final unless otherwise stated.

Paid plan subscriptions renew automatically until cancelled; cancellation takes effect at the end of the current billing period. (Following a companion is free and does not renew or bill.) We don't pro-rate refunds on cancellation. Credits are non-refundable once purchased unless required by consumer-protection law in your jurisdiction. If a paid generation or unlock fails for technical reasons, we re-attempt delivery or return the credits — you are not charged for failed deliveries.

Billing questions and chargebacks. Charges appear on your card statement under the billing descriptor shown at checkout. If you do not recognize a charge or have any billing problem, contact legal@daika.ai before disputing with your bank — we resolve legitimate billing complaints, including refunds where warranted, within seven (7) days. Initiating a chargeback on charges you did authorize, instead of contacting us first, may result in account suspension.

7. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. We don't guarantee availability, accuracy, or appropriateness of generated content.

To the maximum extent permitted by law, our aggregate liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD 50, whichever is greater.

8. Termination

You can delete your account at any time from account settings. We can suspend or terminate accounts that violate these Terms or the Content Policy. On termination your data is removed per the Privacy Policy's retention schedule.

9. Changes

We may update these Terms. Material changes will be notified in-app and by email where applicable. Continued use after a change means you accept the revised Terms.

10. Content complaints and removal

If you believe any content on the Service is illegal, infringes your rights, appears to depict a real person, or otherwise violates these Terms or our Content Policy, report it to report@daika.ai (use dmca@daika.ai for copyright claims). This reporting channel is open to anyone, whether or not they hold an account with the Service. We review every complaint and, where warranted, remove or disable the content within seven (7) business days. Any person who believes they are depicted in content on the Service may request its removal, and may appeal the outcome of that request. If a disagreement about removal or consent cannot be resolved between us, it will be referred to a neutral third-party body for resolution at our expense. If content is determined to be non-consensual or unlawfully depicting a person, it is removed immediately. Where a report concerns intimate imagery depicting an identifiable real person without their consent, we remove the content within 48 hours of a valid request, as required by law, and make reasonable efforts to remove identical copies.

11. Adult content and age verification

The Service, and in particular the Intimate category, contains AI-generated adult content, including sexually explicit text and images. As described in Section 3 above, all of that content is entirely AI-generated fiction — it does not depict, and is not intended to depict, any real person or event.

Intimate / adult features are 18+ only, on top of the age attestation you make at signup (Section 1). Depending on your location and applicable law, we may also require you to complete a separate age-verification step (for example, through a third-party verification provider) before you can access explicit content. Attempting to bypass, falsify, or share access to age verification is a violation of these Terms.

12. Your data and international storage

By using the Service you acknowledge that your personal data is stored on servers located in the European Union (Germany). Your chat and photo content is additionally processed transiently by our US-based AI infrastructure providers to generate responses and images — they do not retain your data after processing it. See the Privacy Policy's International Transfers section for the legal basis and details.

The Service is operated by SodoLabs.ai LLC, a limited liability company registered in the State of Wyoming, United States. These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules, and disputes arising under them are subject to the courts located in Wyoming, except where mandatory consumer-protection law of your country of residence provides otherwise.
